A man’s violent response to the “best bit of advice” he was given but didn’t take at a family Christmas lunch which turned horrific has landed him in jail for almost a year, a court has heard.

Loganlea man Kohnrad Troy Kimlin, 23, pleaded guilty in the Ipswich District Court on November 1, 2022, to one count of grievous bodily harm.

Crown prosecutor Andreas Galloway told the court Kimlin had been drinking throughout the day on December 4 last year at a family Christmas lunch, when his grandmother’s boyfriend told him he should stop drinking as he was “getting pissed”.

Kimlin responded aggressively by pushing him in the shoulder, and the 63-year-old told him not to touch him.

Mr Galloway said Kimlin then walked out into the yard, took his shirt off and yelled “get out and fight me”.

His grandmother’s boyfriend said he wouldn’t fight him, but Kimlin came at him from behind and kicked him in the back, causing him to fall.

Kimlin then stood over him, punched him in the face and kicked his body.

A family member tried to pull Kimlin back but he broke free and punched the older man in the face again and kicked him twice more in the back.

Eventually two family members were able to pull Kimlin off the man and the family called emergency services.

Kimlin was arrested the same day but refused to be interviewed by police and spent the next 322 days in custody.

The victim suffered a fracture to his leg, requiring surgery, along with a skin tear and abrasions on one arm.

Mr Galloway said the man was predicted to fully recover from the attack but could potentially suffer ongoing effects from the leg fracture.

He noted Kimlin’s criminal history included violent offending, such as a common assault charge, and said he had committed this most recent offence just a day after being sentenced in Beenleigh Magistrates Court to 12 months imprisonment with immediate parole release.

Defence barrister Geoffrey Seaholme said Kimlin had “significant mental health issues” and “obviously an issue with alcohol”.

Judge Alexander Horneman-Wren said Kimlin’s offending was a “vicious and protracted attack” and noted the fact he had offended so soon after the prior sentence was a “tragic outcome”.

He told Kimlin the victim’s suggestion that he stop drinking was “probably the best bit of advice that you were given but didn’t take”.

Kimlin was sentenced to two and a half years imprisonment, to be served cumulatively to his prior sentence, with parole eligibility set for December 3, 2022.
