An Ipswich man who raped his wife despite the woman being in pain after giving birth to their second child has faced court.

The crown described the man’s actions as a complete invasion, degrading, humiliating, aggressive, and predatory and noted he showed absolutely no remorse or care for his then wife’s welfare.

The rapes occurred at the pair's Ipswich home days after the woman gave birth to their second child in early 2018.

The court heard the horrifying acts had a lifelong effect on the mother of two as it had affected her work and studies at the time, and struggles with relationships.
The court heard the horrifying acts had a lifelong effect on the mother of two as it had affected her work and studies at the time, and struggles with relationships.

When the woman’s mother, who had been helping out left, the now 44-year-old man told her that it was her job to satisfy her husband.

Despite the woman saying no to any sex due to her pain he would not take no for an answer.

He also is alleged to have put his hands around her neck.

He later told police he grabbed her throat because he was “being kinky”.

When confronted over the behaviour he told her, “don’t be silly, you loved it”.

Five days later the woman had to relive the same horror despite protesting and expressing her aversion to the rape.

She was feeding her newborn when he ordered her back into the bedroom.

She was still in pain from the last rape and protested – he didn’t care.

The court heard while in prison the man was allegedly raped by an inmate and it had made him remorseful for his past actions.

Crown prosecutor Andreas Galloway said the man “used (the woman) as an object for his own sexual gratification”.

Mr Galloway said there was a need for denunciation of his actions especially considering the prevalence of sexual violence in a domestic violence setting, and asked for a nine year prison sentence.

At the Ipswich District Court on December 9, the man pleaded guilty to rape and perverting the course of justice.

The latter charge arose during a pre-trial of the rape case before the Ipswich court in 2019.

Judge Dennis Lynch said the man coached his wife to lie to the jury so his charges would be dropped, although his wife had covertly recorded the conversations catching him out.

After the rape when she went to police she also covertly recorded a pretext phone call with the man, where he laughed about what he had done and said he had the right to do as he pleased because she was his wife, and “that’s just what guys do”.

When sentencing the man, Judge Lynch said he would take into account the positive letters from his shocked family, lack of criminal history, mental health support received and the two years he had already spent in jail.

Judge Lynch sentenced him to eight years imprisonment, and set his parole eligibility for September 8, 2022.

When the man walks out of prison, a protection order will still be in place to protect his ex-wife and children.

The order expires in 2026.
