The two victims of an allegedly horrific kidnapping and torture ordeal will give evidence in a Crown prosecution case where telecommunications ciphr data from encrypted mobile phones is expected to form key evidence.
Ipswich magistrate David Shepherd has agreed to submissions by defence counsel for two of the accused men, allowing Belgian model Caroll Dufailly and businessman boyfriend Eduardus Groenewegen to be cross-examined.
The couple is believed to have returned to Europe and will appear by video-link in late December to be cross-examined.
The defence application was made on behalf of accused men Nathan John Miller, 35, from the Gold Coast; and Mark Clinton Atta-Singh, 41, from Helensvale.
They are two of six men, some with alleged links to outlawed motorcycle gangs, who have been charged with the kidnap and torture of the couple, and other serious charges labelled to be serious organised crime offences.
The other four men charged are Jordan Roman Brennan, 25, from Robina; Justin John Kuhner, 40, from Fairfield in Sydney; Saleh Atasoy, 34, from Southport; and Brodie Jeet Singh, 43, from Coolangatta.
Prosecution will allege those involved were dressed in black police tactical response gear when a series of incidents began at a Raceview property late in the evening of October 25, 2019.
The property was the home and business of Mr Groenewegen and Ms Dufailly.
Charges include entering a dwelling with intent by break at night use/threaten violence when armed – serious organised crime; doing acts intended to cause grievous bodily harm; two counts of kidnapping; administering poison with intent to harm; two counts of torture; assaults causing bodily harm while armed/in company; two counts of deprivation of liberty; use, threaten violence when armed; two counts of extortion with intent to gain benefit with threat of detriment serious personal injury; face masked, blackened or disguised with intent to commit serious offence; and impersonating police officers.
When the cases of Miller and Atta-Singh were mentioned in Ipswich Magistrates Court by DPP legal officer Andreas Galloway, Magistrate Shepherd said he had signed a draft order allowing the defence applications.
The agreed line of questioning had been discussed at a previous hearing.
Mr Galloway said both complainants had been contacted and would give evidence by video-link.
Both Mark Atta-Singh and Nathan Miller will appear in person at the courtroom.
