Reginald John Marshall charged with common assault

The surname of a man, revealed in court to be ‘Mr Dick’, took on new meaning when he was accused by his assailant of sending nude photos to a Gympie woman, a court has heard.

Details about the alleged images, described by Magistrate Kurt flower as “dick pics” were read out in Gympie court on Tuesday.

The court heard the accused photo sender was approached by 57-year-old Gympie man Reginald John Marshall at Nelson Reserve about 5.30pm on August 9, 2021.

Marshall grabbed him by the collar and pushed him.

Mr Dick was then taken to Gympie Hospital, but suffered no significant or long-lasting injuries.

He went to the Gympie police station the next day to make a complaint about the assault, and nine days later, police approached and charged Marshall with the assault.

Police Prosecutor Michael Phillips said Marshall could not provide an explanation for his actions, other than “he was frustrated and angry”.

He was serving a suspended sentence at the time of the assault.

The court heard Marshall had a history of violence, including an instance where in June 2021 when police were called to the Gympie Hospital Emergency Department after Marshall challenged another man to fight.

Defence lawyer Chris Anderson said there was no skin on skin contact or strangulation during the interaction.

Magistrate Fowler sentenced Marshall to four months in jail with an immediate parole release.

A conviction was recorded.
