Gympie magistrate Bevan Hughes was quick to acknowledge that Kilkivan man Shane James Yule was “not a bad person” but that he had broken the law as it currently existed in Queensland when he was caught with almost a kilo of cannabis.
Yule, 60, pleaded guilty in the Gympie Magistrates Court on Thursday to possessing 993 grams of cannabis and to possessing a utensil used in connection with the smoking of cannabis.
The court heard he was busted by police at Kilkivan on December 5, 2024, and that while he did have priors from the 1980s onwards, he had not been convicted of breaking the law since 2015.
A reference tendered to the court described him as “a good friend” and “a kind and generous person”.
Yule, wearing a neck brace, said he used the cannabis for pain relief after breaking two bones in his neck, but that he would get a legal prescription for the drug moving forward.
He was sentenced to three months jail, suspended for nine months.
