Man in court for smashing tail lights in front of partner and child

A young father who smashed into his car while in a rage has faced a Gympie court.

A young father smashed his own car tail lights while a toddler sat inside the vehicle after the child’s mother drove recklessly in the man’s front yard.

The man, who cannot be named for legal reasons, pleaded guilty in Gympie Magistrates Court on Monday to contravening a domestic violence order.

The court heard that on October 9, 2022, at 2.30pm, the man’s partner was driving his Holden Commodore and slid the car on the front lawn of his mother’s house.

She “spun the wheels on the grass and sent that vehicle into a small slide,” police prosecutor Vicki Kennedy-Grills said.

Their 18-month-old child was sitting inside.

The woman’s 21-year-old partner become enraged and began yelling at her to stop the car, the court heard.

She got out of the car and retrieved a screwdriver from the boot.

Police were told she did not threaten the man but walked towards him shouting, with the tool clenched in her hand. He took it off her and started smashing up his own tail lights, with the toddler still in the car.

The court heard the man then tripped over, landing on top of the woman and holding her down to “calm her”.

The woman later told police it was “all her fault” and she was the one who had to be restrained.

Sergeant Kennedy-Grills said the incident was arguably “mutually combative” but the man was charged for holding the woman down, shouting at her and breaking his tail lights in front of her and the child.

He was fined $400 and convictions were not recorded.
