A Tamaree man, caught doing burnouts outside his ex-girlfriend's house and refusing to undergo a breath test, has been sentenced.

Donald Hamilton, 35, pleaded guilty in Gympie Magistrate Court on Thursday to wilful driving in a way that caused unnecessary smoke and noise, obstruction of police, driving without a license repeatedly, failing to provide breath for test, failing to provide saliva for test, public nuisance, and contravening a police direction.

He committed all seven offences one month after being released on parole.

The court heard on December 29, 2021, Hamilton was told by his children that they were no longer allowed to visit him at his home.

The next day, he went to his ex-girlfriend's house and confronted her and her husband.

Later that day, the husband drove to Hamilton’s location and told him to stay away from his wife, which resulted in an argument.

The court heard Hamilton decided to buy a bottle of Jack Daniels to calm himself down but it ended up making things worse.

“Jack Daniels is not the answer,” Magistrate Chris Callaghan responded.

Hamilton proceeded to get in the car and drive back to his ex-girlfriend’s house and began doing burnouts and making excessive noise before her husband called the police.

“He has gone into the community with absolutely atrocious behaviour that’s not acceptable,” Police Prosecutor, Melissa Campbell said.

Defence Lawyer Laura Nightingale accepted her client had made “pretty ridiculous decisions”.

Hamilton received a $2000 fine and had his license disqualified for a total of seven months.
