Carla Lutgenau charged with dangerous driving over fatal Mary Valley crash

A 44-year-old woman charged over a fatal car crash that killed Mary Valley mother of seven Kathleen Dennis did not appear in court, and neither did her lawyers.

A 44-year-old woman charged over a crash that killed a beloved Mary Valley mother of seven is expected to fight the allegations.

Carla Anne Lutgenau has been charged with two counts of dangerous operation of a vehicle causing death or grievous bodily harm while adversely affected.

Her case was mentioned in Gympie District Court on Monday and Tuesday, July 8-9.

Kathleen Dennis, 56, died in the crash between her vehicle and another on the Kandanga Imbil Road in September 2022.

Ms Lutgenau was scheduled to be indicted on Monday but the matter was adjourned after no representatives for the 44-year-old appeared.

The matter returned to the court on Tuesday, where Chris Anderson, acting as a town agent for Ms Lutgenau’s privately retained lawyers, told the court his instructions were to seek an adjournment until the court’s next sittings in August.

Mr Anderson said a schedule of facts had only been provided “last Friday”.

Judge Jennifer Rosengren pushed back on the request, saying she was “not prepared” to move so far and questioned why a brief and conferencing with her counsel could not be sorted by the end of the week.

“I can’t see any reason … why that can’t occur,” Judge Rosengren said.

Crown prosecutor Michael Andronicus said the matter was “likely to be contested” and was opposed to a lengthy adjournment given the missed indictment on Monday.

Judge Rosengren agreed to adjourned the matter to Monday, July 15.
