A GYMPIE man who took advantage of a woman in her own home was jailed for rape this week at Gympie District Court.

Ian Fredric Awee, 45, who has no previous criminal record, was sentenced to six years behind bars when he pleaded guilty to the serious offence. He will be eligible for parole in two years.

The court heard Awee went to a Gympie woman's' home about 8.30pm on August 10, to deliver goods.

After sharing a drink on the balcony, the woman allowed Awee to massage her sore shoulder while she sat fully clothed on the couch.

It heard the woman, who had had three drinks, fell asleep.

She then recalls waking up in a different position, with her pants removed and the defendant having sex with her.

She pretended to stay asleep while the defendant dressed himself and reclothed her.

The court heard Awee texted the woman the next day, saying he had not been able to wake her when she fell asleep so he had covered her with a blanket.

When questioned by police, he admitted to visiting the woman but said he had no recollection of events.

DNA tests confirmed the presence of the defendant's DNA.

Magistrate Gary Long said it was a gross breach of trust due to the situation he was in.

He said it was a serious violation which had significant impact on the victim.

"She was not in a position to give you consent," Mr Long said.

"Offending of this kind is serious because of the violation of the body of another human being."

Awee will be eligible for parole on June 2, 2017.
