Gympie man denied bail over alleged choking, DVO breach
A Gympie arborist sobbed in the dock as the court heard he allegedly choked his partner ‘to her last breath’ and was only stopped when his 10-year-old child intervened.

A 29-year-old Gympie arborist sobbed from the dock in Gympie Magistrates Court on Tuesday, as details of the day he allegedly choked his partner ‘to her last breath’ were read out.
The man, who cannot be named, is charged with two domestic violence offences including choking or strangling his partner and breaching a domestic violence order on October 4.
He was supported by three people in the public gallery, who could also be heard sobbing throughout his appearance.
The court heard the man allegedly strangled his victim during an argument, and grabbed her by the throat with both hands and dropped her to the ground.
Magistrate Chris Callaghan said while the man had both hands around the victim’s neck, he allegedly told her “I’m going to f---ing kill you”.
“She felt she was being squeezed to her last breath,” Mr Callaghan said.
The victim was said to be close to blacking out, and the alleged assault only stopped when the couple’s 10-year-old child intervened and screamed for the man to stop.
The man then left the house and police were called.
Duty lawyer Laura Nightingale told the court her client was the breadwinner in the family and provided for the victim, who was unemployed.
She said her client hoped to be granted bail, so he could continue working and provide for his children.
But Mr Callaghan said the man had an “appalling history” of domestic violence related offences, with seven past breaches of a domestic violence order, and one assault charge in 2020.
Bail was refused.
The man was remanded in custody, and will return to court on Wednesday, October 6, for mention.
