From a pub brawl at Dicey’s to friends arguing over a cab fare, three men were sentenced for public nuisance charges in Gladstone Magistrates Court this week.

A punch-up erupted at a busy Gladstone bar after Troy Stephen Stewart, 41, told his opponent to ‘pull your head in and f--- off’, a court heard.

Stewart, 41, pleaded guilty in Gladstone Magistrates Court on Tuesday  to public nuisance.

Police prosecutor Kelvin Boyd said police were called to Dicey’s Irish Bar and Grill in relation to a disturbance on September 23, around 8.10pm.

There had reportedly been a fight between several people on the bar’s balcony and when police arrived they conducted interviews with those involved.

Stewart stated he was seated at a table with friends on the balcony when an unknown man approached his group and after making comment towards them, Stewart told the man to ‘pull your head in and f--- off’.

The man then walked over to Stewart and hit him on the chin.

Stewart made admissions to throwing two punches back towards the man, stating his actions were out of self-defence, with the unknown man falling over unconscious.

Shortly after, Stewart was involved in another fight with a friend of the man, with security having to separate the brawlers.

Police obtained a statement from a witness who said after hearing a commotion outside on the balcony, she saw Stewart standing over the man appearing to move his body over the railing.

The witness also stated she saw Stewart involved in a fight, knocking over glasses and tables on the balcony.

Stewart was arrested and released on a bail undertaking to appear in Gladstone Magistrates Court.

Magistrate Bevan Manthey convicted and fined Stewart $800 and recorded a conviction.

Kaine Allen Wright, 31

A night out which turned sour nearly landed a Gladstone man in prison after his extraordinary outburst was heard in court.

Kaine Allen Wright, 31, pleaded guilty in Gladstone Magistrates Court on Tuesday to public nuisance and obstructing a police officer.

Police prosecutor Kelvin Boyd told the court Wright was the passenger of a taxi on Glenlyon Road on October 21, around 11.20pm.

During the cab ride home, an argument broke out between Wright and his mates about the best route home.

The argument became heated and Wright started yelling loudly, “I just want to f---ing go home man, I just want to f---ing go home”.

The four continued to argue with Wright’s friend standing in his face yelling something until Wright forcefully pushed her back yelling “sit down c---”.

The taxi driver hailed down a police car and requested the passengers be removed due to their behaviour.

When police had almost finished their interaction and were in the process of negotiating payment for the cab when Wright approached them and yelled they “weren’t going to pay for s---”.

Shortly after abusing the friend, again, Wright was arrested by police and a search was conducted

Wright started yelling at police and told them he had four grams of heroine, two grams of cocaine and four ounces of meth.

Wright was given instructions to move his feet apart which again he ignored and continued to yell at police, calling them “c----”.

Mr Boyd said the highlight of Wright’s performance was stripping nude in front of the female watch house officer, much to her dismay.

Magistrate Bevan Manthey convicted and sentenced Wright to two months imprisonment, wholly suspended for 12 months. Convictions were recorded.

A man threatened a witness by stating he should have “kicked his teeth in last time”, a court heard.

Marc Dyball, 46, pleaded guilty to public nuisance in Gladstone Magistrates Court on Tuesday.

Police prosecutor Kelvin Boyd said Dyball and the witness were known to each other due to a family conflict.

“On July 31, Dyball was walking past a unit block on Auckland Street, Gladstone Central when he spotted the witness’ car parked outside.

“The defendant walked into the courtyard and upon seeing the witness he vented his frustrations about an ongoing financial dispute.

“Dyball yelled in a loud, threatening tone “come outside and I’ll bash ya. I should have kicked your teeth in last time.”

When the witness did not respond to the threats, Dyball made his way back onto the footpath outside the unit block and called back to the witness, referring to him as a “dog” and “scum”.

On August 1, police attended Dyball’s residence and spoke with him regarding the incident.

Dyball admitted he challenged the witness, however, offered the excuse he was frustrated by the ongoing family conflict.

Dyball also agreed with police he simply could have chosen not to enter the unit which would have prevented the issue from occurring.

He was arrested and released on bail to appear before Gladstone Magistrates Court.

Magistrate Bevan Manthey convicted and placed Dyball on a 12 month, $800 good behaviour bond.

A conviction was recorded.
