A Gladstone man begged an Acting Magistrate for his bail application to be approved, claiming there were people after him in jail.

A man who allegedly attempted to defraud a second-hand shop appeared in Gladstone Magistrates Court on Monday, begging for his freedom.

Kevin Douglas Anderson, 28, applied for bail on three alleged offences including failure to appear in accordance with an undertaking, stealing and fraud.

A court heard Anderson was released on a bail undertaking from the Gladstone watch house on September 12 to appear in Gladstone Magistrates Court on September 14, however, allegedly failed to do so.

On September 13, after a warrant was issued for his arrest, police allege Anderson checked into a motel on Coon Street, South Gladstone and paid for a one-week stay.

Anderson allegedly left the motel early on September 18 and the manager realised Anderson had stolen his room keys and a 32-inch TV that was inside.

The manager was allegedly forced to climb through the window to gain access to the room as the defendant had the only key to the room.

Due to Anderson’s alleged actions, the manager was unable to rent the room out to other guests due to having no keys or TV in the room.

On September 27, police allege Anderson took the stolen 32-inch TV to a second-hand shop on Auckland Street, Gladstone.

The defendant allegedly traded the stolen TV for $62 cash and claimed the TV was his.

On October 10 Anderson was arrested at his mother’s house in Gladstone Central.

When Anderson saw police, he walked quickly into the house and locked the door.

His mother convinced him to attend the door as she was aware he was wanted.

Anderson offered no lawful or emergent reason for missing court and stated, ‘I forgot’ and ‘My Mum usually tells me when court is’.

He was arrested and transported to the Gladstone watch house where a receipt from the second-hand shop was found in his wallet. His bail was objected to by police.

Anderson’s lawyer Rio Ramos said her client was disputing the charges before the court.

“In our position he may be spending significant time in custody pending the resolution of the matters, that’s a big concern for him,” he said.

“He could ultimately end up spending until May in custody given the trial calendar being so full.”

Anderson interrupted court proceedings to inform Acting Magistrate Ron Muirhead that he believed the TV was not stolen and that he had a receipt for it.

Police prosecutor Senior Constable Carl Spargo said Anderson was at high risk of reoffending if he was granted bail.

“In relation to the stealing charge, my submission is the prosecution’s case is quite strong,” he said.

“He was the only one with a key to the room, he took that TV down to the second-hand shop and when he was located he had a receipt from that second hand shop in his wallet.”

Mr Muirhead said he agreed with the prosecution’s submissions and refused Anderson’s bail.

Upon hearing his bail application had been refused, Anderson made pleas for his freedom.

“I can’t go to jail, there’s people after me man,” Anderson said, before the video link was terminated.

Anderson’s matters will be heard again at 2pm on November 8 in the Gladstone Magistrates Court.
