Billy Roy Nelson avoids prison after pleading guilty to 16 charges in Gladstone Magistrates Court

A Central Queensland man who threatened to kill police in a foul-mouthed tirade has been ordered to ‘pull his friggin’ head in’ by a magistrate as he was sentenced on 16 charges.

A Central Queensland man was ordered to ‘pull his friggin’ head in’ by a Gladstone Magistrate after being sentenced on 16 charges.

Billy Roy Nelson, 19, pleaded guilty in the Gladstone Magistrates Court on Monday to charges including evade police, serious assault of a police officer and stealing.

The worst of Nelson’s offending occurred on July 15, when police attended a Fraser Drive address in Moranbah.

Nelson was questioned by police as a suspect in other matters and became highly aggressive and verbally abusive towards police.

He made statements such as, “f---up ya dog” and “tell me ya f---ing mutt”.

Nelson then proceeded to threaten police by saying, “wanna fight c---?” before police arrested him.

When police attempted to handcuff Nelson he tensed his arms which prevented police from being able to restrain him and he was put on the ground.

Nelson continued to verbally abuse police saying, “let me up, we’ll have a go c---” and “you spastic f---”.

Seconds later, Nelson raised his left shoulder off the ground, turned his head and spat at a Senior Constable who warned him it was an offence and not to spit again.

Police placed Nelson into the police vehicle for transport, however, as they were closing the door Nelson spat at the same officer once again.

Nelson’s aggressive and abusive behaviour continued on the way to Moranbah watch house, where Nelson made threats to kill police officers.

Magistrate Bevan Manthey said Nelson, who had served two weeks of pre-sentence custody, had endured enough time in prison.

“However, you will be straight back in there if you don’t pull your friggin’ head in and have a big think about things,” Mr Manthey said.

“You treat the probation period I am going to place you on like a jail sentence, you breach it and you are going back in there.”

Nelson was convicted and sentenced to two years imprisonment, wholly suspended for two years, and two years probation. Convictions were recorded.
