Alleged DV offender denied bail in Gladstone court

An alleged Central Queensland domestic violence offender has been refused bail after police said he was “too much of a safety concern” - here’s why.

An alleged Central Queensland domestic violence offender has been refused bail after police said he was “too much of a safety concern”.

The man appeared in custody in Gladstone Magistrates Court where he applied for bail.

He is charged with contravening a domestic violence order (aggravated offence) and breaching bail.

The court heard the man was in a show cause situation and the prosecution opposed bail.

Solicitor Cam Schroder said the man denied the allegations and if granted bail, he could reside with a family member in Gladstone, report to police five days a week, wear an electronic monitoring device and do domestic violence counselling.

In objecting to bail, the prosecution said the man’s proposed bail address was 100m from the aggrieved’s residence.

“And given his history, he continues to breach the domestic violence order... he completely disregards the orders that the court imposes,” the police prosecutor said.

“The bail address that’s been provided is just too close and causes too much of a safety concern... considering he is continually breaching it (order) - it would be a different story if he didn’t breach the order again and again.

“But in this instance, he keeps breaching it and it’s too high of a risk for that address.”

Magistrate Mary Buchanan noted the man was in a show cause situation because he’d been convicted of a domestic violence offence in the past two years and he was currently on parole and bail.

She also said the prosecution case was “strong”.

Ms Buchanan said she was not satisfied the man had shown cause and bail was refused.

The man was remanded in custody and his matters were adjourned to December 9.
