Shane Edward McCormack pleads not guilty to driving without due care and attention

A man charged with driving without due care and attention, among other offences, earned the ire of a magistrate when he repeatedly interrupted him in court.

A man who repeatedly spoke over the top of a magistrate was warned not to interrupt him again during his brief court appearance.

Shane Edward McCormack pleaded not guilty to driving without due care and attention, failing to comply with a requirement to stop a private vehicle and driving a defective vehicle when he appeared before Maryborough Magistrates Court on Monday.

Dressed in jeans and a blue shirt, Mr McCormack represented himself during the appearance.

Mr McCormack repeatedly interrupted Magistrate John Milburn until Mr Milburn told him not to “talk over the top of me”.

“It’s as simple as that Mr McCormack, you will wait until I am finished and then I am in a position to hear what you’re saying,” Mr Milburn said.

Mr Milburn read the charges out to Mr McCormack, who entered pleas of not guilty.

The alleged offences happened on the Bruce Highway at Owanyilla on January 27, 2023, the court heard.

Police prosecutor Sergeant Sonia Edwards confirmed a brief of evidence had been disclosed to Mr McCormack regarding the matters.

Mr Milburn said a hearing date would be set for April 3, 2025.

He said the prosecution evidence would be heard at that time, as well as any evidence Mr McCormack wanted to provide.

Mr Milburn said if Mr McCormack wanted to obtain legal advice or assistance, he was free to do that ahead of the hearing.

“I won’t be doing that,” Mr McCormack responded.

Mr McCormack would remain on bail ahead of the hearing, the court heard.
