Matthew Ryan Marsh in court for assaulting his mother

A former mill worker who raised his hand to his mother during a heated argument found himself on the receiving end of a kick to the groin and a knee to the stomach.

A mother was forced to kick her son in the groin after he came towards her and raised his hand at her, a court has heard.

Matthew Ryan Marsh, 39, pleaded guilty to common assault when he faced Maryborough Magistrates Court on Tuesday, June 25.

Police prosecutor Sonia Edwards said about 7.50am on February 27, Marsh went to his mother’s home.

He overheard a phone conversation between her and another person and tried to take the phone, Sergeant Edwards said.

When his mother tried to stop him taking her phone, she was backed into a corner.

Marsh then raised his hand with an open palm, causing her to feel fear, Sgt Edwards said.

His mother then kicked him in the “direction of his groin” to get away from him before kneeing him in the stomach area and asking him to leave her house.

Other parties then called the police, Sgt Edwards said.

An interview was conducted with police and Marsh told them there had been a heated argument and he had tried to grab the phone.

“Due to the heated argument, the aggrieved did feel fear when the defendant raised his hand. She had taken action to defend herself and asked him to leave the residence,” Sgt Edwards said.

Duty lawyer Morgan Harris said Marsh’s mother was present in the court supporting him, and the two were now on good terms.

Marsh was awaiting a referral to a psychiatrist in relation to undiagnosed PTSD, Mr Harris said.

Mr Harris said Marsh had a good work history and had previously worked doing manual labour, including at sawmills.

Magistrate John Milburn said Marsh had been in a “heightened state” of the emotions at the time of the incident.

His mother took action as a result to ensure she wasn’t hurt as a result of the “real threat” she perceived from him, Mr Milburn said.

Marsh was placed on 12 months probation and a conviction was recorded.
