Starting a fight in the bottle shop of a Hervey Bay hotel has landed a man before court.
Damien Craig Bashford, 29, pleaded guilty to one count of public nuisance and one count of wilful damage when he faced Hervey Bay Magistrates Court on Thursday.
Police prosecutor Sergeant Kim Harwood said on May 23, 2024, Bashford had gone to the drive through liquor store attached to the Kondari Resort.
She said Bashford had observed a male person known to him entering the store and followed him inside.
An assault took place, Sgt Harwood said, with Bashford pushing and punching him multiple times.
The attack had continued throughout multiple aisles of the store, which was occupied with multiple patrons and staff members.
The bystanders had to move out of the way of the fight, Sgt Harwood said and Bashford’s behaviour had caused concern among the staff members, who then called police.
During the fight Bashford damaged multiple boxes containing large bottles of wine and Sgt Hardwood said there was then a breakage and wine had split out onto the floor.
CCTV footage was obtained of the incident which showed the defendant and Bashford later attended the Hervey Bay Police Station on August 4 to take part in an interview regarding the incident.
He made admissions to starting the fight in store and said he was remorseful.
Restitution was sought for $108 for the damaged wine.
Magistrate Trinity McGarvie said she took into account the fact that Bashford had voluntarily gone to the police station and made admissions regarding the offending.
Bashford was given a head sentence of three months in prison, wholly suspended for six months.
