Joshua Trevor Berrigan charged with killing Nathan Isaac McPherson

A young father accused of throwing a punch that led to a man’s death appeared briefly before court on the Fraser Coast on Tuesday via videolink.

A young father accused of throwing a punch that led to a man’s death appeared briefly before court on the Fraser Coast on Tuesday via videolink.

Joshua Trevor Berrigan, 23, has been remanded in custody on a charge of unlawful striking causing death following an incident in August 2023, that resulted in the death of Nathan Isaac McPherson, 43, the following day.

Nathan Isaac McPherson, 43, died in the Royal Brisbane Hospital on Sunday, August 20, after he was involved in an altercation near the intersection of Kent and Richmond Streets in Maryborough about 2.30am on Saturday, August 19.

Mr McPherson was taken to Hervey Bay Hospital before being transported to Brisbane with life-threatening injuries, later dying of those injuries.

During Tuesday’s court appearance, Mr Berrigan’s legal representative said the matter had been erroneously committed for trial before there was any medical material disclosed.

He said he had been in contact with staff from the Director of Public Prosecutions’ office about the evidence.

“The director’s office took the view that Mr Berrigan may have been denied procedural fairness perhaps by having proceeded through committal without identifying and examining that medical evidence,” he told the court.

Three injured in midnight crash

The legal representative said he was asking for an estimated time to receive additional evidence from the DPP’s office.

He asked that magistrate John Milburn order that a brief of evidence be disclosed.

Mr Milburn said he would order a full brief of evidence be disclosed to Mr Berrigan’s legal representatives.

The legal representative said there would not be a bail application for Mr Berrigan.

The matter was adjourned for further mention on January 22.
