The lawyer for a labourer with an 11-page criminal history has told a court his client suffered from depression, and had committed more of a ‘high level trespass’ when he tried to break in to a Maryborough woman’s home.

A Maryborough burglar was crash tackled to the ground by a member of the public after the woman who lived there saw him trying to break in and raised the alarm.

Darren Loyde Anderson, 35, pleaded guilty to trying to enter a dwelling and commit an indictable offence, stealing and wilful damage when he faced Maryborough Magistrates Court this week.

Anderson was in custody and appeared via videolink.

The court heard he had an 11-page criminal history and had spent time in jail in the past.

Defence lawyer Morgan Harris said Anderson had been on parole at the time of offending, but it had not been suspended.

He was a mature offender with “previous bouts of work”, mostly labouring positions, Mr Harris said.

He had difficulty with his mental health, and had previously self-medicated with alcohol and cannabis.
Mr Harris described the attempted break and enter as more of a “high level trespass”.

He said Anderson was “crash tackled by a male member of society” when the incident happened.

Mr Harris said Anderson had been born prematurely, had experienced learning difficulties in the past and had been diagnosed with depression.

Anderson had been physically assaulted when he was younger, resulting in an acquired brain injury, he said.

He intended to live with his mother upon his release.

Magistrate John Milburn said the main concern was the attempt to enter a dwelling.

The victim was a woman who saw Anderson trying to break into her home, Mr Milburn said.

“It was in the afternoon, which is an unusual time,” he said.

The woman asked a male person to help her and he had grabbed Anderson and tackled him to the ground, Mr Milburn said.

In relation to the other matters, Anderson had stolen liquor in a separate incident and broke a toilet facility.

Mr Milburn noted Anderson had experienced disadvantage in his upbringing and said he was trying to address his mental health issues.

Anderson was given a head sentence of six months in prison, wholly suspended for 12 months.
