A man who punched a police officer in the face during a violent drunken outburst in Dalby has been sentenced in court.

Michael Whitmore was asked by police to move away from a Clarke St home on January 2 after he was spotted by nearby residents shouting and swearing in the street.

Dalby Magistrates Court heard that the 20-year-old continued to hurl abuse when he was told by police to move along, saying “I don’t give a f--k” before repeatedly shouting “c--t”.

Police prosecutor Derek Brady said officers then told Whitmore he was under arrest for obstructing police, at which he lunged out and punched one of them in the side of the face.

“(Whitmore) was kicking out at police as they attempted to restrain him,” Sergeant Brady said.

The Dalby man left his target with visible redness and swelling on his face, and shouted “You f--king cop c--t” before he sprinted away on foot.

Whitmore was eventually tracked down at nearby AFL grounds and breath-tested at the scene, recording a blood alcohol concentration of 0.155.

The court heard it was only months earlier in October last year that Whitmore and a group of unnamed accomplices were busted damaging a sign and bin in front of the Mitre 10 store.

Defence lawyer Julia Molloy said her client had not consumed alcohol since the January incident and had changed medications the day prior, which was believed to have played a role in his mental state at the time.

Whitmore pleaded guilty to one count each of assaulting police causing bodily harm, public nuisance, obstructing police, wilful damage and contravening a bail requirement.

He was placed on probation for six months and ordered to complete 40 hours’ community service. He was also told to pay $300 in compensation to the police officer.

No conviction was recorded.
