Dalby man, 38, faces magistrates court after breaking into house to sleep off ‘drug bender’

A Dalby man was found by police sleeping in the bedroom of a home he broke into claiming he wanted to sleep off a ‘drug bender’. But things only got stranger from there.

A Dalby mother got a surprise after she called police thinking her house was being broken into, only to discover it was her son sleeping off a ‘drug bender’.

Dalby Magistrates Court was told the 38-year-old man, who has a domestic violence order in place with his mother that prohibits him from being within proximity of her, broke into her home on September 3.

The court was told his mother heard a noise and thought it was a stranger breaking in and called the police.

Police prosecutor Chris Hutchins said the offending, while at low level, was significant.

“His intention was to seek shelter and sleep off a bender, so he stayed in his bedroom which is where police found him,” he said.

“Ultimately he tried to get away and kicked out at officers.”

The court was told while the man kicked out multiple times at an officer it didn’t make contact.

Earlier in the year, the man was also busted by police with 3.4g of marijuana and had intended to drop it off to someone.

The court was told he committed the offences while on a suspended sentence handed down in Dalby District Court.

Defence lawyer Julia Molloy said her client who had spent 103 days in pre-sentence custody started drug use in his 20s and had been excelling during his time in jail as he’d gone from kitchen hand to chef.

He pleaded guilty to possessing drugs, utensils, supplying drugs, assaulting police, obstructing police and contravening a domestic violence order.

Acting magistrate Melanie Ho congratulated the man on his achievements in prison and declared the 103 days as time served.

He was made eligible for parole on March 20, 2023.
