A man accused of choking the mother of his children until she dropped to the ground after a fight over her declining to have sex has been found not guilty by a jury.
Bobby Douglas Bass was acquitted of strangulation and common assault.
It was alleged the Chinchilla man swore and yelled at his 43-year-old former partner of seven years because “she wouldn’t make love to him the night before”.
Crown prosecutor Brendan White told the court it was alleged the 46-year-old then followed his now ex to the kitchen where he pinched her shoulder and wrapped his arm around her neck while pulling her backwards.
“She wasn’t able to breathe and made a choking sound,” he said.
The court heard the woman lost her balance and fell to the ground.
The jury also heard the triple-0 phone call the woman made to police in 2020 after the alleged strangulation and assault occurred where the Chinchilla man could be heard yelling in the background.
Defence barrister Frank Martin suggested the woman was motivated to make the claims because Mr Bass accused her of stealing from his bank account, noting police found no injuries and the woman didn’t mention being choked during the initial triple-0 call.
The woman told the court she didn’t do so because the police didn’t ask.
The jury deliberated for an hour and a half before finding Mr Bass not guilty on all counts.
