TreeSpec CQ owner David Rawiri Edwards in court over alleged assault of Justin Karl Herlihy

The Central Queensland businessman allegedly beat his victim with a metal pole, leaving him with life threatening injuries.

A committal hearing date has been set for the case of David Rawiri Edwards, who allegedly beat a man with a black metal pole at Moranbah.

Edwards, the owner of TreeSpec CQ, appeared at Moranbah Magistrates Court on Thursday, August 12, for a charge of acts intended to cause grievous bodily harm, and two fresh charges of breach of bail condition and contravene the direction or requirement of police.

At Edwards’ first appearance on November 2, Magistrate Robert Walker said Edwards allegedly took a metre-long black metal bar and struck Justin Karl Herlihy in the shin area before striking in other areas including his head, face and arms in a “brutal” assault.

Mr Herlihy was allegedly left in his own car outside his mother's house on Mills Avenue, Moranbah, before being flown to Mackay with life threatening injuries and extensive broken bones.

Criminal lawyer Andrew Hanlon, of Potts Lawyers, appeared via phone on Thursday and explained the matter was adjourned in July to allow him and prosecution to determine a suitable date for a committal hearing.

Prosecution has agreed to cross examine three witnesses at a committal hearing at Emerald Magistrates Court on November 19, the court heard.

Mr Hanlon said he was unable to proceed with the fresh charges as he was yet to receive a QP9 from police outlining the charges, although he expected those charges to “take a certain course”.

Magistrate Robert Walker listed the matter for mention at Emerald Magistrates Court on October 19, for the court to be advised of the scope of cross examination and for Mr Hanlon to proceed with the fresh charges.

Edwards was remanded to appear on October 19. His supreme court bail was enlarged and he was granted bail for the two new charges.
