A Central Queensland man charged with a string of serious alleged offences including torture remains in custody awaiting a higher court date.

Lionel Thomas John Spurr, 48, appeared in Emerald Magistrates Court on Tuesday charged with one count each of assaults occasioning bodily harm, deprivation of liberty – unlawfully detain / confine, torture and wilful damage.

Mr Spurr appeared via link from Capricornia Correctional Centre and did not enter a plea or apply for bail.

The details of his alleged offending were not revealed in court.

Mr Spurr, who last appeared before the court on December 13, 2022 according to court documents, took the chance to apologise to the court for his behaviour at the December appearance.

“I was a bit disrespectful to you last time, I’ll apologise for that,” Mr Spurr told Magistrates Rosemary Gilbert.

Mr Spurr told the court he had applied for representation through Legal Aid Queensland and was waiting for a response.

“I’ll apply for bail down the track at the Supreme Court date,” Mr Spurr said.

“I just needed these charges lifted up.

“Whatever the process is to get these charges lifted up into the higher court because that’s where they’re going. I’m just looking to have that done.”

The court heard there was a brief of evidence regarding his matters available, but it had not been disclosed to me Mr Spurr due to the delay in his Legal Aid application.

Police prosecutor Tasman Murphy told the court the brief was only partial due to outstanding reports.

“Police are awaiting a doctor’s statement and medical records,” Mr Murphy said.

“Hopefully, by the time Legal Aid are retained they’ll be available and they’ll have the full brief, and they’ll work from there.”

Mr Spurr’s matters were adjourned for further mention in Emerald Magistrates Court on February 14, 2023.

He will remain in custody to appear via video link.
