Drunk Kodie Langtry assaulted a police officer at Capella Hotel in 2022

A drunken night out at the Capella Hotel ended in a man being tasered by police after seriously assaulting an officer. He later damaged a police vehicle so badly it was rendered inoperable.

A drunken night out at the Capella Hotel ended in a man being tasered by police after seriously assaulting an officer.

Kodie Troy Langtry pleaded guilty in Emerald Magistrates Court on February 14 to one count each of serious assault police that caused injury, assault police, public nuisance in the vicinity of licensed premises, removal of persons from licensed premises, possess dangerous drugs and two counts of wilful damage of police property.

Police Prosecutor Tasman Murphy told the court the charges stemmed from a drunken incident at the Capella Hotel on August 26, 2022.

The court heard Langtry was asked to leave the venue due to his level of intoxication but refused, and police were called.

When police arrived and located Langtry, he became aggressive.

“He’s pushed a senior constable causing him to fall backwards into the heavily grassed culvert, onto his wrist causing him immediate pain,” Mr Murphy said.

“While the senior constable was down, Langtry has attempted to swing a kick at him but has fortunately missed him.

“The officer was required to go to hospital to have his wrist fully assessed.”

The court heard Langtry was tasered and arrested, but continued to act aggressively.

“Once inside the police vehicle, Langtry has kicked the back of the door and window, causing it to break,” Mr Murphy said.

“Smashing the glass, bending the entire door frame, effectively rendering it inoperable.”

The drama continued at the Emerald Watch house, where Langtry was found with 2g of cannabis.

“Langtry has continued to goad another senior constable calling them ‘dog’ and ‘you dog’,” Mr Murphy told the court.

“He’s pointed aggressively at the senior constable saying ‘do you have a f---ing head on your shoulders? Otherwise I’ll knock the c--- off’.

“He’s then spat all over the watch house door.”

The court heard Langtry had a criminal record dating back to 2010 with similar offences.

Defence lawyer Roland Pianta of Crossan Legal told the court his client was so intoxicated at the time of the offending he didn’t clearly remember what happened.

He said Langtry spent three nights in the watch house.

Mr Pianta said Langtry had left the premises by the time police arrived and wondered why police needed to talk to him.

He told the court his client felt ‘ashamed’ of his actions, was seeking help through Alcohol Tobacco and Other Drugs and had decreased his drinking to a total of 12 beers since the incident.

Magistrate Rosemary Gilbert told Langtry if alcohol made him unpleasant, aggressive and a clearly violent person, he had no business using it.

“You called the duty manager a dog,” Ms Gilbert said.

“You appeared both highly agitated and aggressive when the senior constable spoke to you.

“You asked if you were under arrest and when he said you were, your removed your shirt, you said ‘I’m going to f--- you up’.

“You rushed to towards the senior constable, you pushed him with both your hands forcefully to his chest.

“He was able to get to his feet, he could put sufficient distance between himself and you such that he was able to engage his taser, and you were tasered by him.

“Upon being placed in the back of the police car after you had been tasered, you kicked at the door and the window and the back of the vehicle a number of times.

“While at the Emerald Watch house you called another senior constable a weak dog, and a c---, you made threats towards him.

“You bashed against the watch house door, adding insult to injury, you spat a large amount of saliva at the watch house door.”

Langtry was ordered to pay $1765.63 in restitution for the damage caused to police property and was convicted and not further punished for the drug offence and licensed premises offence.

For the remaining offences he was sentenced to a total of six months prison, wholly suspended for 18 months. Convictions were recorded.
