A Bundaberg man has spent the past few months in jail after spitting on two police officers, fronting up to cars driving past his house and generally making a nuisance of himself in the community.
Willem Kyle appeared in custody at Bundaberg Magistrate courts on Thursday, July 14, on multiple charges of what was described as “pest behaviour”.
Kyle was charged with eight offences, including three of committing a public nuisance, two assault a police officer and one charge of stealing.
The court heard charges spanned a period of several months, with the first dating back to November 20, 2021, when Kyle was living with his mother.
After drinking heavily at home, he made his way onto the road and began fronting up to passing cars, it heard.
Kyle’s mother was so worried for his safety she called police.
When they arrived, Kyle began to shout and resist arrest, and spat on two different officers.
Magistrate Edwina Rohan described his behaviour as “disgusting”.
The court heard that during the arrest, Kyle also stomped on one of the officers’ feet, and kicked a second, causing bruising.
He was charged with two counts of assaulting police, and one of obstructing police.
When he was taken back to the watch house it became obvious he was very drunk, as he could not sit up by himself, the court heard.
In January 2022, outside of Bert’s restaurant on Bourbong St, Kyle noticed a person ride past on a scooter. He tried to stop the scooter, and eventually forced the person off it.
Other members of the public left the area out of fear for their own safety, the court was told.
Police were called, and Kyle became verbally aggressive and balled his fists.
On April 11, 2022, Kyle stopped a woman with a bike on Bourbong St. The court heard he circled the woman and demanded she give him the bike.
After he continued to harass her, she hid her bank cards and keys and got off the bike. Kyle then rode the bike to the McDonalds on Targo St, where he tried to fight someone in the carpark.
He removed his shirt and shouted abuse, the court was told. Police arrived and he was arrested.
Kyle was remanded in custody for 95 days, until he faced Bundaberg Magistrates Court on Thursday.
Police prosecutor Andrew Pows described his behaviour as an “annoyance to the community,” and recommended jail.
Legal representative Gavin James said Kyle's life circumstances had gone downhill since the start of 2022, and he would need counselling.
“It is clear that Kyle has significant difficulties with substance abuse,” he said.
Kyle was released on parole with a $150 fine.
Convictions were recorded on all charges.
