A Bundaberg OnlyFans model accused of running over a police officer in a stolen car has told a court she thought she was being carjacked at the time.

Aaliyah May Spencer, 19, made a successful application for bail this week after spending the past few months in jail, charged over the incident in late 2024.

Before being arrested, Ms Spencer ran an OnlyFans account with 84 subscribers and 4500 likes.

The self proclaimed Instagram “wild card” was arrested on Sunday, November 17, and charged with dangerous operation of a vehicle, failing to comply with driver duties after a crash, and possessing drug utensils.

Police allege they were checking on an abandoned stolen vehicle in Hurst St in the Bundaberg suburb of Walkervale about 4pm on Sunday, November 17 , 2024, when the plainclothes officer was run over.

They saw two male youths walking behind them towards a silver Subaru Forester, they said.

Upon approaching the car, Senior Constable Harding said he saw Ms Spencer behind the wheel, along with four other individuals, and told her to stop and get out of the car.

Police also alleged a glass pipe used for smoking methamphetamine was later found at her home.

Ms Spencer’s lawyer Robert Burns told the Bundaberg Magistrates Court on Thursday, March 13, that Ms Spencer’s driving on that day could be considered reasonable given that she and the other four occupants of the vehicle thought they were in danger.

He pointed to alleged inconsistencies between statements provided by police and a single witness who was interviewed for 20 minutes after the incident, namely about whether the officers had identified themselves as police or not.

Mr Burns said there was only one non-police witness, and that she had said the police were in an unmarked grey car and wearing plain clothes, and did not announce themselves before running over to the Subaru Forester.

“There were no lights or sirens,” Mr Burns said referencing the witness statement.

Snr Const Harding was “ half in the car trying to get the keys out” before the former Kepnock High student reversed onto the curb and drove away, he said.

The witness comment conflicted with police statements, which claimed the officers had identified themselves when instructing the 19-year-old to stop the vehicle, the court heard.

Mr Burns also said doubt remained over whether Snr Const Harding was run over by Ms Spencer’s car.

Documents included in the police brief indicated he fell to the ground and made contact with the vehicle, but details beyond that were unclear, he said.

Early injury reports said Snr Const Harding was taken to Bundaberg Base Hospital with minor chest and foot injuries, and later discharged.

Photos documenting his injuries were described to the court as “bruising, superficial scratches and scrapes”, which Mr Burns said were not consistent with someone who was run over by a sizable car.

In response, police prosecutor Vicki Kennedy-Grills said Snr Const Harding remained in hospital until Monday, November 18.

He did not self-discharge from the hospital on the same afternoon as the incident, as Mr Burns said, but was discharged by staff before he elected to go to a second medical facility for further treatment.

Ms Kennedy-Grills also said the second officer at the incident remained on long-term sick leave after witnessing “his partner of the day run over by a vehicle”.

A statement from the second officer is yet to be submitted to police.

When Mr Burns tried to respond to comments made by Ms Kennedy-Grills, magistrate John McInnes said he was “pushing at an open door”.

Mr McInnes granted the 19-year-old bail with a number of conditions, including she not drive and she be accompanied by adult family members when leaving the house between 8pm and 6am.

Mr McInnes said he granted bail in part because of her vulnerability in prison and because her craving for methamphetamine had been reduced as a risk factor given the amount of time she had spent in custody.

An application for bail was denied in November, 2024 and Ms Spencer had been in custody since.

Ms Spencer was not required to appear, but her mother and grandmother were present.

Her mother broke down upon hearing of her daughter’s release that night.

The case was adjourned until May 19, 2025 in Bundaberg Magistrates Court.
