A Bundaberg man has been given a suspended jail sentence after being busted driving 34km over the speed limit on a Monday during “school time”.
Lee Anthony Robinson, 38, pleaded guilty in Bundaberg Magistrates Court on Thursday to failing to provide a specimen of breath for analysis.
The court heard that on April 18, 2022 on Branyan Drive, Robinson was pulled over by police for a breath test.
He admitted to having consumed alcohol, did not give a sample, with the court hearing that as a smoker he struggled to produce adequate breath for testing.
It was later found Robinson had a blood alcohol reading of 0.261, for which police issued him a traffic infringement notice.
Magistrate Edwina Rowan said Robinson’s actions placed both himself and other road users at risk because people with such a high blood alcohol reading often had no recollection of events while under the influence.
Ms Rowan said it was to Robinson’s credit that he had no criminal or traffic history and that he held a “very responsible” position of a financial controller and was of good character.
Ms Rowan said, however, that it was an “extremely high reading”.
Robinson was sentenced to a three-month period of imprisonment, suspended for 12 months.
He was disqualified from holding a licence for 15 months.
