Tilt train staff were forced to call police ahead of their arrival at the Bundaberg Station, after a man’s lewd rant in front of children caused a disturbance.

Appearing via video link from the Maryborough Correctional Centre, Darren Grahame Files pleaded guilty in Bundaberg Magistrates Court to one count of public nuisance, one court of possessing utensils and one count of possessing dangerous drugs.

On March 12, Files was on-board the tilt train and intoxicated when he started to abuse staff at around 3:10pm.

The court heard he was so erratic, staff were forced to call triple-zero.

Police were waiting for Files when he got off the train at Bundaberg Station at 3:43pm.

Staff members told police Files said to one attendant to “hold my ball sack and rub my balls on the ground”.

The court heard he then told a female attendant she “stank” and made comments about her sexuality.

When police asked Files for his name, he replied, “sniff my nuts”.

The prosecutor told the court there was a large number of witnesses to the abuse, including children.

Files was arrested and taken to the Bundaberg Watchhouse where police found him in possession of a brass metal pipe and 1.44 grams of cannabis.

Addressing the magistrate as “your worship”, Files said he was on parole at the time of the offences last month and was taken back to prison after serving time from September last year.

“It’ll be two to three months until I’ll be released,” he said.

Files told the court he had been working for a business contracted by the Department of Transport and Main Roads to build a bridge for the Cooroy to Curra project and had been living in Gympie.

Acting Magistrate Patrick Murphy told Files his parole was suspended until now and he would not punish him.

“Only because you’ve been returned to custody because of this,” he said.

He was convicted and not further punished.
