Jimmy Nguyen sentenced for negligent driving in collision at Beverly Hills

A barman has learnt his fate for running over a woman – causing a brain bleed and leg fracture – who was crossing the road in Sydney’s south.

A barman has learnt his fate for running over a woman while she was crossing the road, causing injuries that required her to use a walking frame.

Jimmy Nguyen, 35, was sentenced in Sutherland Local Court on Tuesday after he pleaded guilty to negligent driving causing grievous bodily harm.

Agreed facts tendered to court said Nguyen was driving a Nissan Maxima along Stoney Creek Rd in Beverley Hills about 7.15pm on August 25 last year.

When he turned into Mercury St at about 30km/h, he crossed over double unbroken lines.

Nguyen struck a woman, aged in her sixties, in the middle of the road as she crossed.

The impact caused her to land on the bonnet of Nguyen’s car before she bounced off and fell on the road.

Nguyen immediately pulled over to the side of the road and rendered assistance to the woman until paramedics and police arrived.

The woman was taken to hospital for a fractured femur, injured hand and brain bleed.

She required surgery on her leg and was treated for the haemorrhage before she needed to attend follow-up appointments with specialists.

She also required the use of a walking frame to assist her, documents said.

Nguyen, who returned negative drug and alcohol tests, was arrested and provided police with his dashcam footage.

In court, Nguyen’s lawyer Vinny Vijay said his client “accepted responsibility” for his actions and acknowledged he “did not keep a proper lookout”.

The lawyer noted Nguyen did have a blind spot in his car, it was dark and the woman was on the phone.

The court heard Nguyen had no criminal history and had completed a traffic offenders program.

Mr Vijay said Nguyen had struggled mentally with the trauma and shock of the collision.

The court heard Nguyen worked at a city venue as a bar staff member and therefore needed his licence to return from work after finishing in the early hours of the morning.

Magistrate Jillian Kiely noted Nguyen’s actions were negligent not dangerous, accepted he was remorseful and felt shame about the collision.

She noted his traffic record was not “worst” she had seen, adding his last offence was in 2019.

Ms Kiely said there was a need for drivers to keep a look out of their surroundings before she convicted Nguyen, placed him on a nine-month conditional release order and he was disqualified for driving for 12 months.
