Glassing at Gold Coast bar

A young Gold Coaster glassed another man at a rooftop bar after “sleazy comments” were made about his girlfriend.

Marc Kristian Layzell claimed the glass slipped when he was throwing a drink in the other man’s face at The Island Rooftop Bar, Surfers Paradise about 10pm on November 21 last year.

Immediately after the assault, Layzell went and sat on a chair like a “stunned mullet”, the Southport Magistrates Court was told.

The victim was left with a 1.5cm cut on his face.

The 20-year-old pleaded guilty on Thursday to assault occasioning bodily harm.

Magistrate Joan White sentenced him to 12 months’ probation and ordered he pay $3000 in compensation. No conviction was recorded.

“The problem is, Mr Layzell, it’s all too common that people come before this court, particularly young males, people who have been drinking and get involved in fights or discussions or whatever you want to call them and it all ends in tears,” she said.

Magistrate White said she accepted Layzell did not break the glass before the throw.

“If you throw a glass at someone they are probably going to be injured, potentially quite seriously,” she said.

Prosecutor Donn Reid played CCTV from the incident to the court.

The footage showed Layzell and his girlfriend at the venue when his girlfriend takes an unused chair from two men at a table.

The woman appears to react to something the men said.

It is then Layzell comes across and throws his drink at one of the men.

The glass follows.

The footage showed Layzell leaving the area and sitting in a chair.

Mr Reid said: “Anytime a glass is thrown at someone’s face the consequences can be extremely severe.”

Defence lawyer James Treanor said Layzell was reacting to “sleazy comments” made about his girlfriend after she took the chair.

“Here the glass is tossed, it never breaks and my client retreats and goes back and sits down and essentially a stunned mullet,” he said. Mr Treanor said Layzell made no attempt to flee or fight anyone.

Mr Treanor said Layzell, who went to high school in Helensvale, was extremely remorseful for his actions.
