A man who brutally bashed another man at a Southport bus stop claims he was told his victim had assaulted a woman just minutes prior, a court has been told.
Dominic Spiros was one of four men captured on CCTV approaching the other man, who was sitting on his own at the bus stop about 9pm on March 24.
Southport Magistrates Court was told Spiros threw numerous quick punches to the victim’s face, with another man dealing a final blow that knocked the victim to the ground.
Spiros and his group walked away immediately afterwards, with bystanders soon rushing to the man’s aid.
He remained in hospital for two days with several injuries including a non-displaced skull fracture and a small bleed and bruise on the brain.
Spiros was on parole at the time of the assault.
Defence lawyer Lee Quinn, of Quinn Law Group, said his client had no previous convictions for violence and had struggled with drugs throughout his life.
Mr Quinn said the 28-year-old was at SOPO Brewing Co with friends that night, where he was told a female patron had been sexually assaulted by the man he would soon attack.
“It was then that Mr Spiros took it upon himself to go and … we saw what happened when he approached the (man),” Mr Quinn said.
He told the court Spiros had the ongoing support of his family and intended to start outpatient counselling and a mental health care plan upon his release, after more than six months in custody.
Magistrate Veena Goverdhan said Spiros’ attack was “very concerning”, especially as he knew neither his victim nor the woman who complained about him.
“It’s time you step up and start taking responsibility, because if you don’t … regardless of the sentence I impose today, you will end up in this position again,” she said.
Spiros pleaded guilty to assault occasioning bodily harm while in company and several unrelated offences.
He was sentenced to two years’ jail, wholly suspended for four years, and ordered to pay $2000 in compensation to his victim.
