‘Creative’ climate lawyers target business
Climate change lawyers are putting businesses and governments on notice that they will face increasingly “creative” strategic litigation claims if they do not get serious about the energy transition and phasing out, rather than just offsetting, carbon emissions.
Leading corporate lawyers say Australia – already the second-busiest jurisdiction globally for such actions – will also continue to be favoured by plaintiffs, despite Tuesday’s high-profile full Federal Court loss in the landmark Sharma climate change case.
