Kumova attacks Swami defence, threatens contempt of court application

Justice Michael Lee said he would consider taking the “extraordinary” step of striking out the honest opinion defence of Alan Davison on the basis the self-styled citizen journalist insufficiently complied with court orders in a defamation battle against sharemarket entrepreneur Tolga Kumova.

The Federal Court judge on Tuesday labelled Mr Davison’s discovery process, which included additional submissions on June 30 and July 3, a “dog’s breakfast”. Tuesday’s legal arguments were dominated by the fallout from Mr Davison’s testimony last week, after he was ordered to travel from New Zealand to give evidence.
