Accused NCA bomber Domenic Perre has been smearing faeces on the wall of his cells, throwing food at guards and flinging medication at doctors as an act of protest while in prison, a court has heard.

During sentencing submissions on charges of trafficking cannabis, the District Court heard that Perre had profound medical issues and was unhappy with both his care and the food in the prison system.

Judge Rauf Soulio also received a letter from the prosecution that was authored by Perre while in prison in 1994.

Prosecutor Ryan Williams said that the letter, which the court heard encouraged another prisoner to “play games” with prison officers and the judicial process, showed a persistent contempt for authority.

Judge Soulio said it was a “long bow to draw” between a letter from 26 years ago and Perre’s current behaviour while behind bars.

Mr Ryan said a report prepared for the court showed Perre’s current disruptive behaviour.

“Your Honour will see a number of examples where it is stated as a fact that the defendant was urinating in his cell in an apparent protest,” he said.

“(He has been) smearing faeces on walls and mirrors, throwing food at those who provide it to him, throwing medication at medical staff and refusing to attend appointments meant to treat him.

“Put simply the standard of care is a high standard, but it requires the defendant’s co-operation.”

Gilbert Aitken, for Perre, said his client suffered from “myriad” medical conditions, including diabetes, heart disease and high blood pressure, and had recently been hospitalised.

Perre was arrested in June 2017 after a drug crop was discovered at a property in Chaffey, near Renmark.

Perre’s brother Francesco, nephew Antonio and sister-in-law Rita were all arrested as part of the police operation.

Guns were found hidden in the walls of Antonio’s northern-suburbs home. Domenic Perre was not charged with in relation to the guns, but was aware they were hidden on the property.

Perre is one of the last people to face sentencing for the offending offending. His nephew and sister-in-law were spared prison, but Francesco was sentenced to more than four years in prison for the offending.

Perre has pleaded not guilty to charges of murder and attempted murder relating to the bombing of the NCA building on Waymouth St on March 2, 1994.

Detective Sergeant Geoffrey Bowen died and lawyer Peter Wallis was severely injured when a parcel bomb exploded in the office.

Perre was originally charged days after the explosion but those allegations were dropped six months later, with prosecutors saying there was “no reasonable chance of conviction”.

He was arrested again in March 2018 and is scheduled to stand trial before judge alone in the coming months.
