A woman allegedly driving a car that hit a tree in a fiery crash – injuring four people – was not street racing, but had drugs in her system, a court has heard.
On Thursday, Zea Ellen Murphy, 21, appeared in the Adelaide Magistrates Court alongside her lawyer Wayne Carlin.
Mr Carlin told Magistrate Simon Smart prosecutors had conceded Ms Murphy was not participating in a street race at the time of the crash, which was previously alleged by prosecutors to be an aggravating factor of the charges she faces.
He said other negotiations were ongoing, but prosecutors rejected that submission.
The court heard an offer by defence had been rejected by prosecutors because evidence showed “illicit substances in the defendant’s system” during the crash.
The Noarlunga Downs woman was charged after a crash on Piggott Range Rd in Onkaparinga Hills on June 10, 2022, injuring herself and three passengers in her car.
In court documents released to The Advertiser, prosecutors alleged Ms Murphy was driving in a “culpably negligent manner, or recklessly, or at a speed or manner dangerous to any person, and by that culpable negligence, recklessness or other conduct caused harm”.
The 21-year-old is yet to enter a plea to three counts of aggravated causing harm by dangerous driving.
She was previously also facing one charge of participate in or prepare for a street race – which was withdrawn by prosecutors.
Ms Murphy’s car allegedly struck a tree before 9pm after it veered off Piggott Range Rd before being engulfed in flames.
All occupants of the car managed to escape, and were taken to Flinders Medical Centre for treatment with non-life-threatening injuries after the crash.
Mr Smart remanded Ms Murphy on continuing bail to appear in court again in August.
