Rebels bikie Daniel Fitzgerald jailed for violent home invasion where shots were fired

A Rebels motorcycle club member is behind bars after he and four other masked men stormed a house and fired shots in a terrifying escalating bikie feud.

A Rebels bikie is behind bars after he stormed a house with others in a terrifying act of revenge before shots were fired.

Daniel Glenn Fitzgerald, 38, was jailed for more than four years for his role in a group’s rampage of terror.

During sentencing, the District Court heard the victim was the brother of two men, referred to in the remarks as X and Y, who had previously been associated with the Rebels motorcycle club but left in favour of another gang.

The court heard X was involved in a physical altercation with another Rebels member, referred to as B, in 2018.

Shots were also fired at an address where Y was living in September 2018 but there was no evidence as to who was responsible for this act.

The court heard the victim and his brother X were involved in an altercation with B on May 24, 2019.

Later that day Fitzgerald attended the apartment of B and purchased crowbars from Bunnings.

“I infer you became aware that some sort of altercation had occurred and B wanted to exact revenge or inflict some form of punishment on that family,” Judge Ian Press said.

Fitzgerald and four others, who were all wearing balaclavas and holding metal bars, then broke into the victim’s Paralowie home.

The court heard the victim and a female who was also in the house had access to a CCTV system which gave them warning of the group’s attendance.

The female called police and they escaped through the front door, with the victim continuing into a nearby reserve.

The court heard the five men left the house and drove the car after the victim.

“When in front of the reserve the car was stopped and two shots were fired from the gun,” Judge Press said.

The Stirling North father pleaded guilty to serious criminal trespass and discharging a firearm to frighten.

Judge Press said while he strongly suspected Fitzgerald fired the gun he couldn’t be satisfied beyond reasonable doubt.

“I am, however, satisfied beyond reasonable doubt that you either fired the gun or you intentionally passed the firearm to another person in the car so they could fire it,” he said.

The court heard Fitzgerald was convicted and then acquitted of the murder of Kym Drover during a home invasion in 2011.

Prosecutors had alleged he was part of a 15-strong armed group who stormed a house in Elizabeth South in an attack prompted by a bitter family feud.

“That time in prison in 2012 did not dissuade you from either continuing your association with the Rebels or committing this particular offence,” Judge Press said.

Judge Press jailed Fitzgerald for four years and two months jail, with a non-parole period of one year and seven months.

The sentence was backdated to December 10.
