Murder charge dropped against two men – Keith Chomik and Douglas Sansbury – who had been accused of murdering Bradley Frost at Modbury

Two men who were accused of the bashing murder of a Modbury man have had the charge withdrawn, while one has been granted bail.

A murder charge has been dropped against two men who were accused of a deadly bashing at Modbury – and one has been released on bail.

The two men – Keith William Chomik and Douglas Wayne Sansbury – who can be named for the first time after suppression orders on their identities were revoked, each appeared in the Adelaide Magistrates Court via video link from prison.

Both men had been charged with murdering Bradley Frost outside his Victoria Drive, Modbury, home about 3pm on March 16.

Mr Frost had suffered life-threatening critical head injuries and died in the Royal Adelaide Hospital a day later.

At the time of the incident, police said Mr Frost’s brother was also injured in the incident.

Mr Chomik, 33, of Modbury North and Mr Sansbury, 34, of Ingle Farm were each arrested in the days after the attack, with one handing himself into police.

Prosecutor Leah O’Donnell told the court the murder against each of the men, and a charge of aggravated causing serious harm with intent, would also be withdrawn.

She said charges of aggravated causing harm and aggravated assault would proceed, but that a plea of guilty to the aggravated assault charge would be accepted for the matter to resolve.

Mark Twiggs, for Mr Chomik, said his client was expected to enter a guilty plea to the aggravated assault charge when the matter returns to court but needed to obtain signed instructions from his client.

Omar Ali, for Mr Sansbury, said it was also likely his client would enter a plea to a charge of aggravated assault and asked his client be released on bail in the interim.

Chief Magistrate Judge Mary-Louise Hribal granted Mr Sansbury bail to live at Ingle Farm and ordered he not leave the state ahead of his next court appearance.

She said she would note on the file that the matter was likely to resolve by guilty pleas on the next occasion, when sentencing submissions could also be heard.

She also revoked suppression orders on the case which had prevented both accused from being identified.
