A meth-trafficking mother who was busted with drugs hidden in the roof of her southern suburbs home has been spared jail, because she is “no longer a risk to the community”, a court has heard.

Aysha Nikita Wilson, 38, was silent in the dock of the South Australian District Court on Thursday morning as Judge Liesl Kudelka sentenced her for trafficking drugs over a six-month period.

Wilson, of Christies Beach, previously pleaded guilty to 24 charges of trafficking in a controlled drug after police raided the home she shared with another co-accused man, whose identity is suppressed, and Melanie Kate Ferenc, 38.

The court heard Wilson trafficked in a controlled drug, namely methamphetamine at O’Sullivan Beach, Christies Beach and other places between June 2, 2021 and March 16, 2022.

In sentencing, Judge Kudelka said the maximum penalty for each of Wilson’s crimes was 10 years imprisonment, or a $50,000 fine.

“On June 2, 2021, police searched an O’Sullivan Beach property and found 21.3g of methamphetamine in a plastic tub in the roof, as well as digital scales, plastic resealable bags, measuring spoons and ice pipes,” Judge Kudelka said.

“The drug had a value of $4500-5000. Undeterred by that, you and (the co-accused) carried on business.

“The balance of the charges are based on listening device material. (The co-accused) was the principal offender – it was his enterprise, he was the one purchasing large quantities of drugs and then selling them in smaller quantities. His street level dealing business operated from the two houses for the six month period.

“You played a pivotal role in the business as essentially a bookkeeper and organiser. You were involved in weighing and bagging quantities of the drugs, sales, money collection and delivery. You received drugs as part payment for your involvement.”

She said police then searched the Christies Beach property in March 2022 and found bags of a substance “containing methamphetamine weighing between .63g and 1.47g”.

Wilson was arrested in January 2023, and pleaded guilty in October that year.

Judge Kudelka said the only appropriate penalty was a sentence of imprisonment, but due to Wilson’s personal circumstances, need to care for her young daughter and difficult upbringing, a suspended term was appropriate.

“In light of your steps towards rehabilitation, I do not consider you pose a significant risk to the safety of the community,” she said.

She sentenced Wilson to 4 years in prison, reduced to three years, four months and 25 days for her early guilty pleas.

She then suspended the sentence upon Wilson entering a three year good behaviour bond.

“This is really improvident because there’s a sentence of imprisonment attached to it,” Judge Kudelka told Wilson.

“If you breach a condition of the bond, the DPP will require you to come back to court and ask that you spend that time in jail.”
