Mark Burgess to stand trial for crash at Golden Grove intersection that killed Adelaide woman Kirsten Rawolle

A man who allegedly mounted a kerb at 80km/h before crashing into two cars waiting at a red light, killing a woman, will stand trial.

Alleged killer driver leaves court after pleading not guilty

A man previously alleged to have mounted the kerb at 80km/h before allegedly crashing into a car stopped at a red light and killing a woman will take his case to trial.

Mark Andrew Burgess, of Hillbank, appeared in the Adelaide Magistrates Court on Wednesday to enter a plea after the three-car collision in February, which killed 32-year-old Blair Athol woman Kirsten Rawolle.

Magistrate Simon Smart read each of the three charges to Mr Burgess to formally take his pleas.

“Not guilty,” the 62-year-old responded from the dock.

Mr Burgess will now face the District Court for trial charged with driving in a reckless or dangerous manner, causing death by dangerous driving and causing harm by dangerous driving.

Ms Rawolle was the “cherished and loving daughter” of Mark and Jenny, a tribute published in The Advertiser in March said, and a “dearly loved” long-term partner to Adrian.

She also had two younger siblings, Tessa and Joel.

Ms Rawolle, who was driving a Hyundai, died at the scene of the crash at the intersection of Atlantis Drive and The Grove Way on Wednesday, February 28.

Court documents previously released to The Advertiser allege Mr Burgess was driving approximately 80km/h in a “culpably negligent manner and/or recklessly” at the time he allegedly hit Ms Rawolle’s vehicle, and was involved in a rear-end accident just minutes before the fatal crash.

The documents alleged Mr Burgess mounted the kerb before hitting the driver’s side of Ms Rawolle’s Hyundai, forcing it into a silver Toyota Corolla also waiting at the red light at the intersection.

The driver of the Toyota sustained non-life-threatening injuries.

A further allegation detailed in the court documents allege Mr Burgess was involved in three “at-fault” historical crashes prior to the fatal crash and allegedly provided “false” information to get his licence back.

They alleged a medical review in 2022 following one of the three crashes resulted in a licence suspension.

Police investigations revealed his driver’s licence was reinstated after filling out a form and undergoing an examination by a GP and he was deemed medically fit to drive.

However, police prosecutors will allege Mr Burgess knowingly provided “false and misleading” information to the Registrar of Motor Vehicles in relation to his medical fitness to drive.

Following entering his pleas, Mr Burgess was remanded on continuing bail to appear in the District Court in the new year.
