MAFS, OnlyFans star Sebastian Guilhaus new bail bid shot down in SA’s Supreme Court

The former footballer, reality TV and OnlyFans star was already enjoying unusually generous bail conditions, the court heard.

Drug trafficking accused MAFS star wants to help others kick addiction

A former footballer, reality TV and OnlyFans star’s second bid to serve as “a role model” for addicts ahead of his drug trafficking trial has failed, with a judge saying his bail is already more “flexible” than most.

On Wednesday, Sebastian Guilhaus asked the Supreme Court to overturn the District Court’s refusal to let him volunteer twice a month for Narcotics Anonymous at the RAH.

He said he wanted to “share his story” with others to aid their “journeys of rehabilitation” and “reinforce” his own ongoing drug sobriety.

Justice Anne Bampton queried how he intended to do that, and what value his “cautionary tale” held for others so long as he intended to fight the charges at trial.

She also wondered why Mr Guilhaus’ strict home detention bail should be further relaxed, given the exemptions already extended to him.

“I’ve never seen home detention bail granted to an apartment building hotel before, with access to its gym, like this agreement,” she said.

“This is an agreement which sets itself apart from many - actually, from most I’ve seen in the time I’ve been sitting in the criminal courts.

“I see from the report that the Department for Correctional Services even refers to its flexibility’.”

Mr Guilhaus, 36, has pleaded not guilty to, and will stand trial in October accused of, trafficking in a commercial quantity of a controlled drug.

Previously, prosecutors alleged SA Police seized 870g of methamphetamine, worth $90,000, from an address in Keswick during Mr Guilhaus’ July 2023 arrest.

Earlier this month, Mr Guilhaus asked the District Court to vary his bail so he could speak at the RAH’s Narcotics Anonymous program twice a month.

He said NA’s conveners had asked him to “stay on” as a “non-professional” speaker and mentor to “share his story” after successfully completing program.

The court was unmoved and refused, saying it was inappropriate to “let someone on home detention, charged with serious drug offences, to be mentoring others”.

On Wednesday, counsel for Mr Guilhaus repeated its case, but stressed their client would “not be mentoring” anyone.

His role, they said, would be limited to serving as “a role model” and telling his “cautionary tale” to show “sobriety can be achieved and maintained”.

Justice Bampton said she struggled with that submission.

“The experience of this court is that drug addiction is a remitting and relapsing condition... your client needs to be commended for his efforts, he’s done very well,” she said.

“However he still has a very serious offence hanging over him, which he’s contesting, and that remains until this case is resolved (regardless of) the story he shares.

“No doubt he would be a great asset to (Narcotics Anonymous) but, at the end of the day, it’s the view of this court that while he’s still facing these significant charges, this application should be refused.”

Mr Guilhaus declined to comment outside court.
