Kevin James Brougham raped an unconscious woman in broad daylight in the CBD

A homeless man was caught on CCTV raping an unconscious woman who had bought him food and alcohol on the side of a city street, a court has heard.

An unconscious woman was raped by a homeless man in broad daylight in the middle of the city after she took pity on him and bought him a Vietnamese roll.

Kevin James Brougham, 49, was found guilty, after a trial by judge alone, of two counts of rape and four counts of indecently assaulting his victim.

On Friday, prosecutor Jeff Powell read a victim impact statement written by the young woman, who described her trauma in the aftermath of the attack.

“This incident has made me feel dirty, violated, ashamed and shocked,” she wrote.

“I was so naive to help someone out, just to be taken advantage of. I just wanted to buy you a Vietnamese roll and ended up buying you alcohol as you asked.

“I am now more fearful of men and they all seem to have ulterior motives.”

The victim said she had no memory of the crime.

“Sometimes I feel that my body isn’t mine anymore,” she wrote.

“I am embarrassed it happened on the side of the road and was captured on CCTV.

“The fact that I don’t remember is even worse because I don’t know how badly I was violated.”

District Court Judge Ian Press heard that the victim had to take emergency contraceptives as well as anti-chlamydia and HIV medication in the wake of the attack.

During the trial in May this year, Judge Press heard that the woman had met Brougham near the Sir Samuel Way Building on Victoria Square on February 2, 2020.

Brougham was wrapped in a sleeping bag and drinking a bottle of wine.

The victim took Brougham into the Central Market, where she bought him lunch and another bottle of wine. The pair went to the entrance of a carpark on Mill St.

“They ate their Vietnamese rolls, they had something to drink and that is the last memory the complainant has of the day until she regained consciousness later on that day in the Royal Adelaide Hospital,” Mr Powell said during the trial.

CBD security cameras captured the pair buying more wine before making their way to the entrance of an apartment carpark on Holland St, near Gilbert St.

Security cameras at the apartment filmed the assault, which was only interrupted when workers from a nearby building intervened. An ambulance was called and Brougham was arrested.

Stephen Apps, for Brougham, said his client did not shy away from the fact the crime was a “crude, rough and violent invasion of someone else’s body”.

He told the court Brougham had a dreadful upbringing and had started abusing alcohol at the age of eight.

However, Judge Press said he rejected any submission from Mr Apps that Brougham had acted with any kind of affection or protectiveness towards the victim during the attack.

Brougham will be sentenced next month.
