Joshua Rossborough to remain in custody after death of Nick Darling at Morphett Vale

Alleged details of the harrowing hit and run that took the life of a 20-year-old man in Morphett Vale earlier this month have been heard for the first time in court.

Joshua Shawn Rossborough, 19, shook his head while staring up at the ceiling as he appeared via video link from the Adelaide Remand in the Christies Beach Magistrate Court while the alleged events that led to Nick Darling’s death were heard.

A police prosecutor told the court an eyewitness arrived home from work around 10pm, when she saw a silver sedan ramming the back of the Toyota HiLux along Flaxmill Rd.

“The witness saw a male hanging out of the rear window of the silver sedan, filming the incident on his mobile phone,” said the prosecutor.

“The HiLux stopped with a passenger getting out when someone from the silver sedan yelled out, ‘I will f---ing kill you’.”

The witness then heard the crash a short time later.

The police prosecutor then alleged that within the next three hours, Mr Rossborough and his co-accused Michael Henley set the silver sedan alight, before ringing Mr Rossborough’s mother to come and pick them up.

“This defendant was in a frantic panic, wanting his mum to pick him up,” the prosecutor said.

“The mother picked up the defendant and ‘Uncle Mick’, also known as Michael Henley.”

Police allege there was a dispute between both the parties earlier in the day, regarding Mr Henley’s vehicle which he believed had been damaged by the driver of the HiLux.

“This was a series of deliberate and violent repeated acts by the (occupants of the) silver Ford and has resulted in the death of someone.”

Mr Rossborough was charged with manslaughter, cause death by dangerous driving, fail to stop at the scene of a crash, fail to truly answer, impede investigation, make false report and fail to comply with the Emergency Management Act.

Mr Rossborough’s original bail address for home detention was denied due to ongoing investigations.

He will appear in court again in August.
