Jason De Ieso murder accused Seywan Moradi to face retrial, court hears

An alleged Hells Angels member accused of murdering Jason De Ieso will stand trial for a second time, a court has heard.

An alleged Hells Angels member accused of murdering innocent man Jason De Ieso amid a bikie war will stand trial – again.

A Supreme Court jury found seven men guilty of the 2012 ambush murder of Mr De Ieso at his Pooraka business on October 10, 2023, but told the court they had been unable to reach a verdict for an eighth accused man, Seywan Moradi.

Mr Moradi, 36, of Walkley Heights returned to the Supreme Court on Monday for a new trial date to be set.

Bill Boucaut KC, for Mr Moradi, told the court he expected a new trial for his client alone would take two to three months, compared with the five month trial of all eight accused which began in May this year.

“It’s very, very difficult to estimate because the first trial … had numerous accused,” he said.

He said there would also be an issue with judge availability.

Jim Pearce KC, prosecuting, told the court the length of any new trial would depend on what elements defence and prosecution could agree prior to a new trial date.

“If the matters are agreed it could be shortened,” he said.

He told the court that should any of the men who were found guilty seek and win retrials, it was possible a retrial for Mr Moradi would be run at the same time.

“It’s possible that the men that have been convicted … might appeal,” Mr Pearce said.

“If there is to be a retrial it would be appropriate for all accused to be tried together.”

None of the men who were found guilty of Mr De Ieso’s murder – brothers Husain Alzuain, 36, of Goodwood, Mohamed Alzuain, 32, of Mile End, Musa Ali Alzuain, 30, of St Morris, and Daniel Mark Jalleh, 34, of Clovelly Park, Ross William Montgomery, 38, of Andrews Farm, Kyle Lloyd Pryde, 35, of Adelaide and Nicholas Sianis, 36, of Beverley – have yet lodged appeal proceedings.

They have 21 days from the date of verdict to do so.

Mr Moradi has maintained his innocence.

Justice Bampton adjourned the hearing to allow the parties to discuss the timing and length of the retrial.

During the trial, the jury was told Mr De Ieso was gunned down at his business, Unique Custom Paint and Panel, on November 21, 2012.

It heard Mr De Ieso was an innocent bystander in an 18-month feud between the Hells Angels and rival gang, the Finks, and that the intended target of the shooting was then senior Finks member Charles Bonnici.

Mr Moradi returns to court later this month.
