Lawyers for Hells Angels’ accused of murdering Jason De Ieso not enough to convict, jury told

A key prosecution witness has been branded a “compulsive liar”, while defence lawyers for bikies accused of murder say there is not enough evidence to convict their clients.

Defence lawyers for bikies standing trial accused of murdering innocent man Jason De Ieso have labelled the prosecution’s key witness a “compulsive liar” and “bottom feeder” in their closing addresses to a jury.

The last of the eight defence lawyers to give their closing addresses in the Supreme Court finished on Wednesday.

Michael Jandy, for Nicholas Sianis, 36, of Beverley, told the jury he would “join the pile on” against the key witness, describing him as a “compulsive liar”.

“(He) is the central pillar of the prosecution case, but this pillar is rotten,” he said.

The key witness, who cannot be identified, gave evidence over several days and told the court he saw the eight accused men, all of whom are linked to the Hells Angels, gathering at a Parafield Gardens house before the shooting.

Prosecutors have alleged the men murdered Mr De Ieso in a case of mistaken identity at his Langford St, Pooraka, crash repair business on November 21, 2012.

They allege senior Fink bikie Charles Bonnici was the intended target of their attack after an 18-month feud between the outlaw gangs.

Mr Jandy said there was a lack of evidence against his client and that there was “something off about this case”.

Nick Healy, for Kyle Lloyd Pryde, 35, of Adelaide said there was “virtually nothing there and certainly nowhere near enough (evidence) for you to conclude Mr Pryde’s guilt”.

He said CCTV footage of the incident could not be relied on because “you can’t tell anything from that footage going to the issue of identity”.

Mr Healy described the key witness as a “proven liar” and suggested he was “one of the real bottom feeders of our time”.

“His motivation was to save his own skin. He’s a bloke who could not lie straight on a massage table and you should feel very uncomfortable about accepting anything he told you,” he said.

Bill Boucaut KC, for Seywan Moradi, 36, of Walkley Heights, said there was “not a skerrick of evidence” that could prove his client was among those depicted on the CCTV at the time of the shooting.

“There is not … a scintilla of evidence, nothing, not a whiff of evidence that Seywan Moradi is number seven, or anyone else for that matter,” he said.

He said the only evidence tying him to the case was from the key witness who he said was “dreadful” and a “self-confessed liar”.

He warned the jury that if they thought Mr Moradi was “probably” at Langford St it was not enough evidence for him to be convicted.

“The fact something probably happened is nowhere near proof beyond reasonable doubt,” he said.

Ellie Mansfield, for Ross William Montgomery, 38, of Andrews Farm said telephone evidence had given rise to a “real possibility” her client was “not present in that driveway … when those shots were discharged”.

Instead she said it was “entirely possible” Mr Montgomery had remained at home at the time of the shooting.

Ms Mansfield also said the evidence of the key witness could not be relied on and that his evidence had a “creative flourish”.

“No-one here, not even the prosecution, are seriously suggesting that you can accept every word that falls from his lips as gospel.”

Counsel for the other four men standing trial accused of murdering Mr De Ieso have already given their defence addresses.

The other four accused are Husain Alzuain, 35, of Goodwood, Mohamed Alzuain, 32, of Mile End, Musa Ali Alzuain, 30, of St Morris, and Daniel Mark Jalleh, 34, of Clovelly Park.

A ninth man prosecutors allege was among the men has since died. All eight men standing trial have pleaded not guilty to murder.

Auxiliary Justice Brian Martin will begin summing up to the jury on Thursday. He is expected to send out the jury to deliberate next week.
