An alleged drug trafficker was packaging and advertising drugs for sale, with his co-accused younger brother’s charges now dismissed.
Dylan Stuart, 22, and Jayden Tyler Stuart, 20, appeared in the Adelaide Magistrates Court on Tuesday after police allegedly uncovered a drug dealing business.
A police prosecutor told the court that a charge determination had not yet been made against Dylan but the charges would be dismissed against Jayden.
The police prosecutor asked for a four week adjournment to finalise the brief for Dylan.
“Mr Dylan Stuart has another matter where he is co-accused with three other gentlemen for manufacturing a controlled drug,” the police prosecutor said.
Police searched a Mitchell Park house on August 19.
“This offending arose out of police attending at his home address to arrest him (Dylan) in relation to that offending, where they found numerous controlled substances packaged in a way for sale,” the police prosecutor said.
“His phone has been reviewed, showing advertisements for those controlled drugs being produced and disseminated to people.”
Dylan, of Mitchell Park, is charged with one count of trafficking in a commercial quantity of drugs and four counts of drug trafficking. He is yet to enter any pleas.
Jayden, also of Mitchell Park, was previously charged with two counts of drug trafficking, which has now been dismissed.
Frank Barbaro, for Dylan, asked for the charges to be dismissed considering prosecution were asking for further time.
“I don’t know whether or not there has been any DNA or fingerprint evidence disclosed,” he said.
Magistrate Simon Smart granted prosecution the adjournment but said didn’t want to hear any reasons why the brief hadn’t been completed at the next hearing.
“If you want a further adjournment, you won’t get it,” he said.
The charges were adjourned until May.
