Craig Harvey allegedly threatened to kill Reynella East neighbour over noise complaint, court told

A court has heard shocking claims a complaint about loud music allegedly turned into the moment a man threatened his neighbour with a gun.

An early-morning noise complaint in Adelaide’s south resulted in a father having a gun pushed into his chest by a neighbour, who threatened to kill him if he told anyone about the altercation, a court has heard.

Craig Harvey, 53, appeared in the Christies Beach Magistrates Court on Monday for the first time since being charged with one count of aggravated threat to endanger life and one count of possessing a firearm with a licence. He is yet to enter any pleas.

A police prosecutor told Magistrate Joanna Martin that Mr Harvey, of Reynella East, had received a noise complaint “in the early hours” of Sunday morning from his next-door neighbour whose children were trying to sleep.

“The first time, all was okay,” they said. “The victim was told the music would stay low but it didn’t, so he had to go back again and knock because it actually got louder.

“When the defendant answered the door on the second occasion, he (Mr Harvey) had a firearm in his hand and pushed it into the victim’s chest between the bottom of his throat and his sternum. The defendant told the victim to ‘get the f*** away’ and started walking and pushing the victim backwards while holding the gun to his chest.

“At the end of the driveway the victim was able to walk away ... the defendant has told him if he tells anyone about this he ‘would make sure’ he was dead.”

A SAPOL spokesman confirmed the victim, who was left uninjured, called the police just after 5.30am – with STAR Group officers, Polair and negotiators brought in to help.

On Monday, the court heard officers conducted a search of Mr Harvey’s property where they allegedly found the weapon located in the lining of a quilt in the main bedroom.

A duty solicitor, for Mr Harvey, made an application for home detention bail for their client to reside at a property in Kudla – about 65km away from his alleged victim.

Prosecution told the court they were opposed to bail due to the seriousness of the offending and the fear of the safety of the alleged victim.

Ms Martin accepted the proposed address was of a considerable distance away from where the alleged incident occurred, but said she was “concerned gravely” about the serious nature of the offending.

“These allegations involve behaviour which would have been nothing short of terrifying,” she said.

“I am very concerned that this behaviour poses a very high risk to the safety of the community.”

Ms Martin declined Mr Harvey’s bail application and remanded him in custody to appear in court in April.
