A convicted sexual offender who preyed upon a girl in a toilet block is allowed to live in the community, but must obey strict conditions.

A convicted sexual offender who preyed on an eight-year-old girl in a toilet block while holding her by the neck is allowed to live in the community, but must obey by strict conditions, including that he not be within 50m of a school or playground, a court has ordered.

On Wednesday, Beau Seeby returned to the South Australian Supreme Court where he heard he was the latest offender to be placed under an extended supervision order.

Already released from custody, Seeby heard he would have to wear an electronic monitoring device for at least 12 months and was prohibited from loitering in any area where a child was.

A week before, counsel for Attorney-General Kyam Maher told Chief Justice Chris Kourakis negotiations with Seeby’s lawyer were underway regarding their application to have him return to parole-like conditions despite serving a full prison sentence.

Seeby, now 27, of Berri, pleaded guilty to one count of aggravated indecent assault – earning up to 30 per cent off his maximum 10-year prison term.

On October 6, 2019, he followed the girl into the toilets of a Riverland Community Club and, while holding her by the neck, sexually assaulted her.

He was jailed for four years in December 2020, with a non-parole period backdated to his arrest in October 2019 – meaning he was eligible for release in 2022.

“I am satisfied that the respondent is a high risk offender and imposes a risk back to the community. I make an extended supervision order,” Chief Justice Kourakis said.

“You must be of good behaviour, not commit any further offences, and will be under the instruction of Correctional Services.

“He must obey a curfew, and be home between the hours of 9pm and 6am, and can only leave for emergency medical or to reduce the risk of death or injuries.

“You will need to wear an electronic transmitter for the first 12 months of this order. You have to attend any programs you are asked to attend, therapy or counselling or educational programs.

“You must not use or have drugs or alcohol. You cannot enter or remain on any licensed premises, and you’ll need to be careful with that because a venue might be licensed without you knowing about it.

“You’re not to directly or indirectly contact, associate with any person under the age of 18 unless you are supervised by a correctional services officer.

“You can’t loiter without any good reason, or be within 50m of any school, kindergarten, childcare centre, public toilet or any place where children are regularly present.”

He is also prohibited from using the internet to communicate with children, and must allow Correctional Services officers to access or examine his devices at any time.

Seeby agreed to the terms of the extended supervision order.
