A former shark fisherman has been refused bail for assaulting a hospital worker for the third time after it was revealed he had previously trespassed at that address with a firearm.
Appearing via video link from Port Augusta Prison, Callen Andrew Watherston shook his head as Magistrate Susan O’Connor refused to grant him home detention bail to his mother’s house.
Mr Watherston was charged with assaulting a hospital worker, trespassing, failing to comply with bail, two counts of unlawful possession and dishonestly receive property.
“I want to know what’s happening to an assault charge, which is now almost 12 months old,” Magistrate O’Connor asked.
“Your client’s done nothing about it after 11 adjournments.”
The court heard on the last occasion, Mr Watherston was alleged to have trespassed in his mother’s home in November last year – the address where he wanted to live on bail.
The court also heard Mr Watherston was also allegedly found in possession of firearms, described as being a “powerhead” used for killing sharks – his former profession – in February.
His lawyer told the court that his client breached bail as he left the state to overcome substance issues but had every intention to return to court.
“It’s when he sought to return to South Australia for his court hearing that he was arrested,” his lawyer said.
Magistrate O’Connor refused to grant home detention on the basis of Mr Watherston’s previous noncompliance when it comes to bail.
The court heard there have been two unsuccessful bail applications for Mr Watherston.
“I am not releasing him to his mother’s house when she is a victim of crime,” Magistrate O’Connor said.
“You client is responsible for his current predicament because of his lack of co-operation and a magistrate said no to bail in June because he’s a flight risk.”
Mr Watherston will appear in court again in July.
