Benjamin Isaac Devitt denied bail again due to his property being deemed in ‘disrepair’

A 46-year-old man who launched into an explosive tirade at a magistrate will stay behind bars on remand.

An Ingle Farm man who previously lashed out at a magistrate when he was denied bail will continue to stay behind bars after his property was deemed unsuitable for home detention, with a court hearing it was “in a state of disrepair”.

Benjamin Isaac Devitt, 46, appeared in the Adelaide Magistrates Court on Tuesday via video link with a continuing application for bail after he was ordered a home detention report last Wednesday.

Magistrate Paul Foley denied the application, citing that the property was not a suitable address due to a number of reasons.

“Officers found the windows of the nominated address smashed, front door broken open and graffiti on the walls,” he said.

“Drug paraphernalia were cited around the doorway and inside the house. Neighbours came out to speak to compliance officers and stated that the previous tenant had been evicted and the property had been broken into multiple times since.

“Against that report, I take the view that it is not a suitable address. The report that I have indicates that the premises that may be available are in a state of disrepair at the moment. ”

Mr Devitt was charged with theft, two counts of assault, throwing missiles and disorderly behaviour after a dramatic gunpoint arrest in the CBD earlier this month.

He allegedly stole from a city store, assaulted staff and fled before patrols caught him throwing rocks at cars earlier this month.

Police allege Mr Devitt entered a shop and stole goods before two staff members – who attempted to stop him – were assaulted.

He then allegedly fled the store while police received reports that a man was throwing stones at passing vehicles on Franklin St.

Police found the suspect on Mellor St and he was arrested at gunpoint after being ordered to the ground.

During his denied bail application last week, Mr Devitt became visibly irate, screaming through the camera with expletives directed at Magistrate Paul Foley who said the accused had a “significant drug issue”.

“You’re in contempt for calling me a drug addict,” Mr Devitt could be heard saying. “I’m not staying here anymore.”

“Can I tell you this? You’re not assisting your position,” Mr Foley replied.

Mr Foley ordered a home detention report last Wednesday due to Mr Devitt’s “recent and significant history”, keeping him behind bars.

“Are you kidding me?” Mr Devitt said. “So it’s my granddaughter’s birthday in two days and you’re saying I’m in here another week?”

Mr Devitt will next face court in late April.
